Dear Sir / Madam,

RE : Case Number: PP-207-539-468

The following are the 'story' between me , Siu Bor Leung (Boris), and Mr Bruce Gibbs (mailbox : brucegibbsuk@yahoo.co.uk), concerning the deal of his asking me to help bidding an item in Japan Yahoo! Auction: http://page4.auctions.yahoo.co.jp/jp/auction/d63613753 (d63613753).  As I am not a member of Japan Yahoo! Auction, I have to bid the item through my agent who is a memeber of this auction site.  On Aug 24, 2006, Mr Bruce Gibbs clearly showed me the photos of the item that he wanted me to bid for him in Japan Yahoo! Auction, that's  http://page4.auctions.yahoo.co.jp/jp/auction/d63613753, even I told him clearly in Email M that he will have "to pay about 25% more than winning price : 20% is for the commission of my agent and 5% is for covering my Paypal cost and something like that.".  Also in Email V Mr Bruce Gibbs said it clearly the maximum he could pay for the item (d63613753) was 40,000 Yen when I asked the highest price he was willing to pay.

On Aug 27 2006 05:39:16 -0700 (PDT), I replied by Email Y clearly to an email (Email X) from Mr Bruce Gibbs Aug 27, 2006, 12:27:47 +0100 (BST) saying that : (1) If he does not send me a deposit, I will not bid the item (d63613753) for him through my agent.  (2) I will refund the amount if we didn't win.  As we have won the auction he ordered me to act on behalf of him, i.e. http://page4.auctions.yahoo.co.jp/jp/auction/d63613753, I'm not obliged to refund him the amount he paid as the deposit, that's the amount concerned in the case PP-207-539-468.  This sum of USD120.00 was immediately become part of the cost of getting the item (d63613753) from Japan as Mr Bruce Gibbs wanted the item at the beginning.  Then, at Aug 27, 2006 06:46:38 -0700  , Mr Bruce Gibbs made up his mind and sent me the amount USD120.00 as a deposit for bidding, and we won the item (d63613753) in Japan Yahoo! Auction.  Therefore, Mr Bruce Gibbs does have no ground to demand for refund.

At 28 Aug 2006 09:09:30 -0700 (PDT), I sent Mr Bruce Gibbs an email (Email AF) saying we've won the auction of the item (d63613753) and Mr Bruce Gibbs replied me through Email AG at 28 Aug 2006 17:24:42 +0100 (BST) that "....until the G-Shock 'DW-6600' 'Godzilla Collection' is sent to you from your agent and then i will send you paymen.".  This means, Mr Bruce Gibbs will pay me the balance for the auction of the item (d63613753) whenever I notice him the item's arrival at Hong Kong and it becomes ready for me to ship it to Mr Bruce Gibbs in the U.K..

At Sep 9 2006 23:11:27 +0100 (BST), Mr Bruce Gibbs showed his concern on the item (d63613753) if it is a fake item by sending me Email AM.  I replied by Email AO to him to explain and in Email AP at Sep 11 2006 23:28:26 +0100 (BST), Mr Bruce Gibbs said to me he understood what I was saying and he ordered me "when you recieve the G-Shock Godzilla Collection from your agent could you make sure everything that is shown on the auction page is what we have recieved.".  This means he was satisfied with my explanation and will pay for the item (d63613753) if I could make sure everything that is shown on the auction page is what we will have received (Surely I could.  Why not?).

From Sep 26 to Oct 3, 2006, I was in China for my own business trip.  I checked and notified Mr Bruce Gibbs at once by Email AV at Oct 4 2006 19:28:13 -0700 (PDT) to tell him that the item (d63613753) has arrived and presented him with detail calculation showing the amount of him that due to me.  I didn't know his unreasonable requisition of asking for refund until I read his email Email AW at Oct 5 2006 14:46:03 +0100 (BST) and all his emails to me during my business trip.

One important point is : To bid the item http://page4.auctions.yahoo.co.jp/jp/auction/d63613753 on Japan Yahoo! Auction was the sole idea of Mr Bruce Gibbs (U.K.).  Before actually paying me the USD120.00 deposit for this auction, I already told him clearly the likely total cost of this item that he would have to pay, and I will refund the amount if we didn't win this auction finally.  After considering for a period of time, Mr Bruce Gibbs sent me the amount of money (USD120.00) that I demanded him to send to me before I would instruct my Japan agent to bid this item (d63613753) for him (Mr Bruce Gibbs).  Before this moment, we have never discussed to see if the item (d63613753) is fake or not, i.e. Mr Bruce Gibbs have to pay the balance that I would demand if the item really arrives Hong Kong for shipment, and it is now arrived.  Mr Bruce Gibbs also claimed wrongly that the merchandise did not match my original description as I have never described/ introduced this goods to him.  He reported this case to you was just because I rejected his unreasonable requisition as you can see.

Best regards,

Boris Siu Bor Leung (Account holder of seiko5ers@yahoo.com)

P.S.(1)  The following are all the emails (Starting  Email A) exchanged between me , Siu Bor Leung (Boris), and Mr Bruce Gibbs (mailbox : brucegibbsuk@yahoo.co.uk), concerning the deal of his asking me to help bidding an item in Japan Yahoo! Auction: http://page4.auctions.yahoo.co.jp/jp/auction/d63613753 (d63613753), and I really have won this item for him through my Japan agent and the item is arrived awaiting final payment :

Good Afternoon Bruce,

I am not sure if we are thinking the same series of models.  Can you provide pics or links for it?  If you can't, I may be able to find some information tomorrow after visiting my suppliers.

Have a great weekend!

Hi Bruce,

Which item?  What's the maximum you're willing to pay?  I can help bidding for you but you have to pay about 25% more than winning price : 20% is for the commission of my agent and 5% is for covering my Paypal cost and something like that.

Hi, Would you be willing to let me contact your agent in Japan, does the person have an e-mail address that i could send him/her an e-mail to see if they could help me out. I don't want to pay the extra money for going through you and your agent if i could just contactyour agent i would be very greatful.

The item that iam looking at that i wan't to buy is the casio G-Shock 'DW-6600', when you do a search it should come up at the top of the list. It is the 'Godzilla Collection' G-shock, it is the only one on 'Yahoo auction Japan' and it is listed at '35,000 yen', i would like to see if the seller would sell the collection for that amount.

Thanks,

Hi, Boris,

Are you still able to help i would be prepared to pay the costs if you could make a reduction to the extra fees that i would need to pay.

Is your agent able to contact the seller of the G-Shock 'DW-6600' 'Godzilla Collection that is listed on yahoo auction japan for '35,000 yen' to seen if the seller will sell it for that price.

If the seller agrees to sell the collection for the auction price, would your agent be willing to send the watch collection to me instead of having to send to you and then you send to me. It should save a lot of time if your agent could send to me.

I have added the photos that are on the auction page to help your agent find the correct auction.

I would be very greatful if you could help me.

Bruce,

I don't get what's "the extra fees".  My agent charges standard commission rate of 20% on the winning price and I paid so before.

My agent is in fact not a person but a group of people living in HK and Japan.  The Japan part will only deal with their HK part that stocks will have to be here finally.  Also, my agent can only ask the seller questions but not direct contact.  JPY35K is only the starting bid and there are intra-Japan delivery and Japan-to-Hong Kong EMS cost will follow.

One thing has just come to my concern is that : After the introduction of this agent, you (and her) can also become my competitor all the ways.  That will not be the final result I would like to see.

Regards,

Boris (HK)

Hi Boris.

The extra fees that i was talking about is the 'your agent charges standard commission rate of 20% on the winning price' that is what i was saying.

I understand that your agent is able to contact the seller but no direct contact.

Would your agent be willing to send a message to the seller to see if he will sell the Godzilla collection for the starting price of 35,000 Yen.

I would like to go ahead with trying to buy this watch, if you could ask your agent to try and see if the seller will sell for the starting price that would be great.

If your agent types 'DW-6600' into the search box on 'Yahoo Auction Japan' the auction with the photos that i sent to you should be at the top of the list, hope this is of help to you.

Hi Bruce,

My agent can ask the seller question openly but if the seller does not reply, the auction page will not even show the question from my agent.  I instructed them to inquire about buying directly at the starting bid price.

On the other hand, if there are competitors join the auction, what's the highest price you are willing to pay?  This question is very important for bidding process.

Boris (HK)

Hi Boris,

I think about 40,000 yen, is about the maximum that i could pay for it.

I would like to try and get it for '35,000 Yen' if it is at all possible.

Did your agent find the aucton that iam talking about, i will include the photos of the auction in this e-mail if that helps.

Hi Bruce,

It's easy to find and did find for them.  I will tell them not to exceed the limit.

Pls be reminded you may have to add about 25% on the winning bid if we won at or below JPY40K.

Please also paypal me USD120.00 as deposit today and I will transfer HKD1,000.00 tomorrow to my agent as the deposit for bidding the item.  If we won, and the stock arrived, you will have to paypal me the balance and I will settle the deal by HKD in order to take the stock.  This process may take about two weeks, according to my past experience.

If you have cash balance in your Paypal account, pls send to seiko5ers@yahoo.com.  Or if your Paypal does not have any balance, pls send the amount to hkboris@mail.com.  As told before, Paypal will bite around 3.5% on the amount you sent to hkboris@mail.com.  I am going to sleep very soon that I will confirm receipt with you tomorrow morning.

Regards,

Boris (HK)

I think about 40,000 yen, is about the maximum that i could pay for it.

I would like to try and get it for '35,000 Yen' if it is at all possible.

Did your agent find the aucton that iam talking about, i will include the photos of the auction in this e-mail if that helps.

Thanks,

Bruce (UK).

If i send you 'USD120.00' will you give me this deposit back if we win the auction, this amount seems far to high for a deposit for an auction.

Bruce,

If you don't send me a deposit, I won't do the same to my agent.  As a result, no bidding will be carried out.

The deposit is in fact the first instalment and is part of the cost of goods.  I will refund if we didn't win.

Hi Boris,

I have just sent you a deposit of '$120.00' to 'seiko5ers@yahoo.com', i would be very greatful if you could now send a deposit to your agent.

Has the seller replied to your agent's qustion, will the seller sell the watch for the start price of '35,000 Yen'.

I have attached the auction photos to this e-mail so that we are clear which auction we are talking about. As you can see the auction is for the Casio G-Shock 'GODZILLA Collection' - DW-6600, as you probably know this collection is very hard to find.

Thanks,

Hi Bruce,

They've asked the question but the seller has not yet replied.  I noticed them I will give them HK$1K for the auction in early morning tomorrow.  They will then keep looking at the auction and will start to bid at the very last few minutes (to prevent competing with the others and push the price upwards).  They are also clear not to bid when the price is over JPY40,000.  The ending time may be extended if the competition is keen.

I confirm with you the photos of the watch you've sent to me is the one we are discussing so far for bidding.

Regards,

Yes Bruce,

The goods will travel inside Japan awhile and will finally arrive at the Japan side of my agent.  They will then send it to HK by EMS immediately.  I will get the break down of the balance and have to pay before getting the parcel.  These processes would take about 2 weeks to happen.  I will check if the parcel received is 100% exactly as showed in the auction before paying them anymore.

Another g-shock collector has seen the auction that we won, and has indicated that he does not think that the watch we have one is 100% genuine, as he says there are a lot of fake Godzilla collections on auctions at the moment that are selling for less than the genuine ones.

Hi Bruce,

The parcel has not yet arrived.

Japan customers can normally buy a G-Shock when it is marketed at once at about 20 - 30% discount so they can still sell a watch below factory price and making a profit.  Japan's Yahoo Auction is famous for its customer creditability because of their personality and the high entrance requirements; people there are buying and selling with great confidence.

As far as I know, the Japan side of my agent has given comment to the seller on Japan's Yahoo Auction and the goods is on their hands.  Except the goods is proved really fake, I think to return the stock without paying it, and/or without a reasonable cause would have serious consequence on their bidding business.

Regards,

Boris (HK)

Hi Bruce,

Both me and the Godzilla package have arrived Hong Kong finally.  Pls read the final price breakdown :

Winning price : JPY35,000

Commission for my agent : JPY7,000 (i.e. 20% of the winning bid)

Bank T/T charge : JPY420

Japan's inland postage : JPY500

Postage to HK : HKD80.00

Total cost at the part of my agent : JPY42,920 x 0.0675 + HKD80 = HKD2,977

As for the package is over 0.5Kg but not 1.0Kg , the registered air mail postage to the U.K. is about HKD150.00

Amount used to cover the miscellaneous costs at my side is 5% of HKD2,977 i.e. HKD149.00

The total amount you have to pay in HKD is $2,977 + $150 + $149.00 - $1,000 (Deposit) = HKD2,276.00

Therefore,

If you pay me by CASH through Paypal, it will be USD300.00 (2,276 / 7.57) whereas 7.57 is the official exchange rate of USD:HKD by Paypal.  OR,

If you pay me the balance by Credit Card through Paypal, it will be USD311.00 (2,276 / 7.57 / 0.9645) whereas Paypal charges around 3.55% on this kind of payment.

Best regards,

Boris (HK)

Bruce,

I read all of the emails between us finally.

I doubt if you are really in short of fund as you asked for a deduction in price of the 1000pcs LE EC Giez of USD340.00 shipped no longer ago.  Then you searched again on Yahoo Auction in Japan for another 1000pcs LE Godzilla 6600 G -Shock costing JPY350,000 (20% commission for my agent and misc fees not included) and asked me to bid for it, and it is arrived.

I even cannot afford the balance of this goods not yet paid (i.e. HKD1,977.00) so please transfer me the amount I told you before : HKD2,276 (CASH), or USD300.00 (Paypal CASH), or USD311 (Paypal thru Credit Card).

Best regards,

Boris (HK)

Bruce,

From this email you've sent to me, I am sure that you are a barbaric yet fuzzy-minded person.  Correct me if I'm wrong.

As a consequence, I would like to write to you the similar way.  Listen up :

Owing to the principle of "A Promise Is A Promise", and as a responsible human being, I will pay the balance of the G-Shock package to my Japan agent, even though bidding it (real or fake) was the SOLE IDEA of you, Mr. Bruce Gibbs.  Clear?

I will not, and am not be able to, and cannot afford to keep this Godzilla G-Shock package.  But for being a buyer with supreme reputation since Day One in the mind of my Japan agent, I will settle the amount between him and me of this unwanted (to me it is!) bidded item immediately as this package is really arrived at Hong Kong, which was originally planned to ship to the U.K. to you, Mr. Bruce Gibbs, after paying me the balance you owed.  Correct?

After getting the item on hand, I will put it for sale by all means.  If this item could be sold successfully within 2 months time, starting from Oct 07, 2006 Hong Kong time, and the total sales proceed exceeds the sum of the balance that I will pay to my Japan agent, and the amount of USD120.00 (or HKD1,000.00, whichever is the higher. USD:HKD is 1: 7.57 in Paypal sense), I will then send you back the amount that you, Mr. Bruce Gibbs (U.K.), sent to me for the deposit of bidding this item, and I really bidded and won it for you, Mr. Bruce Gibbs (U.K.).  If the plan to sell it within 2 months time turns out to be a failure, I will not send you USD120.00 (or HKD1,000.00, whichever is the lower. USD:HKD is 1: 7.57 in Paypal sense) forever.  No Objection!

Best regards,

Boris

You have had my '$120.00 USD for far to long, and there has also been quite some time that you did not make contact with me about this item and that is not acceptable. Iam not a 'fuzzy person' as you seem to think iam, i think you shuld think first before lowereing your self to name calling standards.

So You listen up, 'Boris'.

Iam not prepared to wait two months for you to 'Possibly' send me back my '$120.00 USD', i wan't you to give me a refund Today of the '$120.00 USD' that i sent to you. If this does not happen and i don't recieve my $120.00 refund today then action will be taken by me to get my money back from you.

Bruce,

You didn't (and cannot) disagree the adjective "barbaric" I used on you, yes?

The proposal is fair.  I have been forced to handle your irresponsible decision by having to pay real money out of my own pocket.  The question is : Who's the victim?  You?  You must be persuading yourself that you are!  I would like to tell you that I AM THE VICTIM of this deal that WILL NEVER BE COMPLETED.

One last thing I have to tell you before I will start to market the item tomorrow to get back my (or our) money is : Once I get hurt in the case if I noticed, I will disclose all the information that I know to the public BY ALL MEANS to prevent any victim-to-be in the future, especially whose are internet users, U.K. people, or exactly who are living in Glasglow to deal with you.  That's it.

New Item Not Received Dispute: Case #PP-207-539-468

表單的頂端

表單的底部

Dear Siu Bor Leung,

Mr Bruce Gibbs has opened a dispute for the payment made to you on Aug

27,

2006 indicating that they never received the item.

Your Transaction ID:59977785W87390035

Buyer's Transaction ID:7DS28492WW0245608

There are many reasons why this might have happened. It could be that

the

item is still in transit or was accidentally delivered to the wrong

address. Sometimes buyers open a non receipt dispute too soon because

they

underestimate how long it can take for shipping and delivery.

By opening this dispute, Mr Bruce Gibbs is asking for your help to

resolve

this issue. This is your best opportunity to resolve this problem

before

the buyer escalates it to a PayPal claim or files a chargeback with

their

card issuer.

-----------------------------------

What To Do Next

-----------------------------------

Most of the time, disputes can be resolved quickly and amicably by

communicating with the buyer in the Resolution Center. There, you'll be

able to review the dispute details, post messages back and forth with

the

buyer, or ask PayPal to decide the case by escalating this dispute to a

claim.

- Log in to your PayPal account

- Click the Resolution Center tab

- Review the dispute details

- Post new message to buyer

To learn more about PayPal's dispute resolution process, log in to your

account and click the utorials?link on the Resolution Center tab.

-----------------------------------

Timeframe

-----------------------------------

Mr Bruce Gibbs can escalate this dispute to a PayPal claim at any time

until Oct 26, 2006. On that date, this dispute will automatically

close.

We encourage you to respond to the buyer as soon as possible. A buyer

who

feels that you are working with them to resolve a problem is less

likely to

escalate a dispute to a claim.

Keep in mind that the funds associated with this payment may be

considered

"Disputed" and not available for withdrawal until the case has been

resolved.

Thank you,

PayPal

You say you have the watch but i don't believe that, I don't have my $120.00 so i have lost money.

Incorrect.  We all know you changed your mind suddenly and put me in troublesome situation.  You have stated a case to Paypal some time earlier and I have given my presentation to them already.

You say you have the watch but i don't believe that, I don't have my $120.00 so i have lost money. The parcel (the one you ordered from me on Japan Yahoo! Auction through my Japan agent) is arrived as I told you before.  I demanded you to pay the balance of HKD2,276/USD300/USD311 (depending on method of payment, calculation showed to you before) so that I can have enough fund to repay my Japan agent for this goods that you've ordered but you changed your mind and do not keep your promise in good manner as an adult.  You haven't lost your money but your integrity completely (May be you have never had so far).

Could you send me a refund of $120.00 to my Paypal account and i will never contact you again once i have recieved my refund from you. As told above, I wasted a lot of time and have given my presentation to Paypal about your stated case to them.  They will judge.

Bruce,

It is clear now and you've agreed the amount USD120.00 is not "stolen from" you, but you "sent to" me for a deal you are still to complete?

As you know, our case is under the consideration of relevant department(s) of Paypal.  They will make decision on it within reasonable time.  Don't waste your police force as they have many more important things to do.  Ask your President Bush for help.

So sad to know I guessed wrongly you were not that stupid.  You didn't take into consideration that I am forced to pay for the balance of the Godzilla 6600 G -Shock package that you ordered through me and my Japan agent.  You don't keep your promise as a responsible U.K. human to pay the money you are owing me for the goods you have ordered from Japan through me and my Japan agent.  You are owing me the balance of the goods equals to HKD2,276 (CASH), or USD300.00 (Paypal CASH), or USD311 (Paypal thru Credit Card) as told before but you keep barking for the initial deposit for the item you have ordered from Japan through me and my Japan agent.  The correct logic you should have in your mind : Pay me the balance of  HKD2,276 (CASH), or USD300.00 (Paypal CASH), or USD311 (Paypal thru Credit Card) as told before and I will send you by registered air mail the Godzilla 6600 G -Shock package that you ordered through me and my Japan agent from Japan.  The case will then be settled and we will have no need to wait for Paypal's judgment, yes?

I have prepared, and am still enriching the content of OUR web page.  Who else comes to me for relevant topic will be given a link to read the stupid story.

Take care.

Dear Sir / Madam,

RE : Case Number: PP-207-539-468

To remind you Paypal guys again : This case is not related to non-shipment that tracking information requisition from your system is totally not appropriate.  The case is all about a promise to pay from an irresponsible U.K. buyer.  I have never told that I will contact him frequently as the stock was in Japan that needed several parties to handle before coming to me.  On the other hand, he made his statement to you “I refuse to pay him as i believe that i has no intention of sending me the item, and i is not willing to send me the first part of payment for the item that i have sent him.    From his words, he knew from the very beginning that the amount he sent to me was the first part of (the total) payment and he should pay me more in the future as the stock arrived (at Hong Kong).

The buyer of this case (Mr Bruce Gibbs) claimed he didn't know the total cost that he did tell you a lie.  I told him clearly on Aug 24 in Email M that he has ".... to pay about 25% more than winning price : 20% is for the commission of my agent and 5% is for covering my Paypal cost and something like that." and he know it well before sending me money.     In Email V Mr Bruce Gibbs said it clearly the maximum he could pay for the item (d63613753) was 40,000 Yen when I asked the highest price he was willing to pay.
