Dear Sir / Madam, RE : Case Number: PP-207-539-468 The following are the 'story' between me , Siu Bor Leung (Boris), and Mr Bruce Gibbs (mailbox : brucegibbsuk@yahoo.co.uk), concerning the deal of his asking me to help bidding an item in Japan Yahoo! Auction: http://page4.auctions.yahoo.co.jp/jp/auction/d63613753 (d63613753). As I am not a member of Japan Yahoo! Auction, I have to bid the item through my agent who is a memeber of this auction site. On Aug 24, 2006, Mr Bruce Gibbs clearly showed me the photos of the item that he wanted me to bid for him in Japan Yahoo! Auction, that's http://page4.auctions.yahoo.co.jp/jp/auction/d63613753, even I told him clearly in Email M that he will have "to pay about 25% more than winning price : 20% is for the commission of my agent and 5% is for covering my Paypal cost and something like that.". Also in Email V Mr Bruce Gibbs said it clearly the maximum he could pay for the item (d63613753) was 40,000 Yen when I asked the highest price he was willing to pay. On Aug 27 2006 05:39:16 -0700 (PDT), I replied by Email Y clearly to an email (Email X) from Mr Bruce Gibbs Aug 27, 2006, 12:27:47 +0100 (BST) saying that : (1) If he does not send me a deposit, I will not bid the item (d63613753) for him through my agent. (2) I will refund the amount if we didn't win. As we have won the auction he ordered me to act on behalf of him, i.e. http://page4.auctions.yahoo.co.jp/jp/auction/d63613753, I'm not obliged to refund him the amount he paid as the deposit, that's the amount concerned in the case PP-207-539-468. This sum of USD120.00 was immediately become part of the cost of getting the item (d63613753) from Japan as Mr Bruce Gibbs wanted the item at the beginning. Then, at Aug 27, 2006 06:46:38 -0700 , Mr Bruce Gibbs made up his mind and sent me the amount USD120.00 as a deposit for bidding, and we won the item (d63613753) in Japan Yahoo! Auction. Therefore, Mr Bruce Gibbs does have no ground to demand for refund. At 28 Aug 2006 09:09:30 -0700 (PDT), I sent Mr Bruce Gibbs an email (Email AF) saying we've won the auction of the item (d63613753) and Mr Bruce Gibbs replied me through Email AG at 28 Aug 2006 17:24:42 +0100 (BST) that "....until the G-Shock 'DW-6600' 'Godzilla Collection' is sent to you from your agent and then i will send you paymen.". This means, Mr Bruce Gibbs will pay me the balance for the auction of the item (d63613753) whenever I notice him the item's arrival at Hong Kong and it becomes ready for me to ship it to Mr Bruce Gibbs in the U.K.. At Sep 9 2006 23:11:27 +0100 (BST), Mr Bruce Gibbs showed his concern on the item (d63613753) if it is a fake item by sending me Email AM. I replied by Email AO to him to explain and in Email AP at Sep 11 2006 23:28:26 +0100 (BST), Mr Bruce Gibbs said to me he understood what I was saying and he ordered me "when you recieve the G-Shock Godzilla Collection from your agent could you make sure everything that is shown on the auction page is what we have recieved.". This means he was satisfied with my explanation and will pay for the item (d63613753) if I could make sure everything that is shown on the auction page is what we will have received (Surely I could. Why not?). From Sep 26 to Oct 3, 2006, I was in China for my own business trip. I checked and notified Mr Bruce Gibbs at once by Email AV at Oct 4 2006 19:28:13 -0700 (PDT) to tell him that the item (d63613753) has arrived and presented him with detail calculation showing the amount of him that due to me. I didn't know his unreasonable requisition of asking for refund until I read his email Email AW at Oct 5 2006 14:46:03 +0100 (BST) and all his emails to me during my business trip. One important point is : To bid the item http://page4.auctions.yahoo.co.jp/jp/auction/d63613753 on Japan Yahoo! Auction was the sole idea of Mr Bruce Gibbs (U.K.). Before actually paying me the USD120.00 deposit for this auction, I already told him clearly the likely total cost of this item that he would have to pay, and I will refund the amount if we didn't win this auction finally. After considering for a period of time, Mr Bruce Gibbs sent me the amount of money (USD120.00) that I demanded him to send to me before I would instruct my Japan agent to bid this item (d63613753) for him (Mr Bruce Gibbs). Before this moment, we have never discussed to see if the item (d63613753) is fake or not, i.e. Mr Bruce Gibbs have to pay the balance that I would demand if the item really arrives Hong Kong for shipment, and it is now arrived. Mr Bruce Gibbs also claimed wrongly that the merchandise did not match my original description as I have never described/ introduced this goods to him. He reported this case to you was just because I rejected his unreasonable requisition as you can see. Bruce, I don't get what's "the extra fees". My agent charges
standard commission rate of 20% on the winning price and I paid so before. My agent is in fact not a person but a group of people living in HK and
Japan. The Japan part will only deal with their HK part that stocks will
have to be here finally. Also, my agent can only ask the seller questions
but not direct contact. JPY35K is only the starting bid and there are
intra-Japan delivery and Japan-to-Hong Kong EMS cost will follow. One thing has just come to my concern is that : After the
introduction of this agent, you (and her) can also become my competitor all

instructed them to inquire about buying directly at the starting bid price. On the other hand, if there are competitors join the auction, what's the

noticed them I will give them HK$1K for the auction in early morning tomorrow.
They will then keep looking at the auction and will start to bid at the very
last few minutes (to prevent competing with the others and push the price
upwards). They are also clear not to bid when the price is over JPY40,000.

Yes Bruce, The goods will travel inside Japan awhile and will finally arrive at the
Japan side of my agent. They will then send it to HK by EMS immediately.
I will get the break down of the balance and have to pay before
getting the parcel. These processes would take about 2 weeks to happen.

Hi Bruce, The parcel has not yet arrived. Japan customers can normally buy a G-Shock when it is marketed at once at
about 20 - 30% discount so they can still sell a watch below factory price and
making a profit. Japan's Yahoo Auction is famous for its customer
creditability because of their personality and the high entrance requirements;
people there are buying and selling with great confidence. As far as I know, the Japan side of my agent has given comment to the
seller on Japan's Yahoo Auction and the goods is on their hands.
Except the goods is proved really fake, I think to return
the stock without paying it, and/or without a reasonable cause would have

(Deposit) = HKD2,276.00 Therefore, If you pay me by CASH through Paypal, it will be USD300.00
(2,276 / 7.57) whereas 7.57 is the official exchange rate of USD:HKD by Paypal.
OR, If you pay me the balance by Credit Card through Paypal, it will be USD311.00
(2,276 / 7.57 / 0.9645) whereas Paypal charges around 3.55% on this kind of

The case is all about a promise to pay from an irresponsible U.K. buyer. I have never told that I will contact him frequently as the stock was in Japan that needed several parties to handle before coming to me.
